Can I apply for H4 EAD 180 days prior to expiry?

Hello Anil,
My current H4 EAD is valid until March 2023.
My spouse will be applying for amendment/extension which will increase his H1 validity to 2024 along with my H4 extension as well.

  1. Can I apply for my H4 EAD renewal along with this new h4 extension?

  2. Should I wait until my H4 extension is approved and then apply for H4 EAD?

You can apply for the decision to accept it before 180 days depends on USCIS officer.

Hi Anil, I love your website. It has kept us sane during months of agony around visa renewals. I am in a similar situation as Aneesha here. Are you saying that it’s random roll of the dice where a USCIS officer might reject the case if H4EAD is concurrently files with H1B amendment outside of the 180 days expiration but there is a chance that it might get approved as well (in probably 15 months)? Also, does the rejection happen for the entire package including H1B or just the H4EAD I-765 petition? Thanks a ton!
