I am currently working with employer A and got a job offer with employer B and started my h1b transfer. Once I received the H1b transfer receipt, I started serving my notice period with employer A. I’m almost midway through the notice period and now I received a RFE on the H1B transfer. Can I join employer B even with the RFE, before getting H1B approved?
I dont understand why people take this kind of a risk. One should only resign with their current employer after the H1B transfer is approved. This is the safest way to ensure you maintain your job and status.
Technically you can join employer B on receipt however you always run a risk of getting out of status if your transfer is denied for whatever reason, unless you have a spouse on H1B and your backup plan is to change status to H4.
