Visa will take care of everything. But wait. If u have valid visa then did u try reaching uscis or related dept for i94 correction. This seems mistake on their side. Talk to some immigration lawer . Like Murthy laws . Worth paying and taking advise. U may not need to leave country if u have valid visa right now

Actually they used passport expiration date as admission untill date on I 94 that we did not realize. After coming here we have renewed the passport in US. Still i can just call USCiS without leaving country?

I have contacted my company attorney and they are saying my wife can enter with an old and new passport and then she will be admitted to the visa expiration date which is 07/25. i am confused and Not sure what to follow?

I had similar issue now. My dependent children I-94 is expired on 5th Aug 2024 as per old passport. But they have Visa till 03/2026. They left to India today. Can they re enter in two weeks time or need to go for any visa renewal for 25 days over stay?. Please suggest.

They can re-enter using the existing H4 visa stamp in passport but be ready to answer questions (if asked about overstay).

My H4 visa has been expired on Dec 2023 and I overstayed in USA for 150 days and my husband applied for his H1b extension and we did not know that we need to apply for H4 extension as well, due to lack of immigration knowledge … I retured to India in May and I have recently attended the interview with US consular and she asked the question why you overstayed in USA after your visa expired, I answered it to my knowledge but she was not satisfied and refused my visa for 221(g) and send it for administration process, we even forgot to mention it in ds160 about my unlawful stay in US. Now what should I do and is there any thing I need to do before I got any confirmation from them like NPT or anything

After interview, as the consular said that they kept my visa under Admin process and returned my passport to me. After almost a month,I recently got a mail to submit the passport but
In the ceac visa tracker, A day back it is showed as Refused but after submitting passport it is showing as Administrative process. I don’t understand that the administrative process is just started or the visa is approved as they asked for my passport

They usually ask for passport only when they have completed administrative processing.

You should get your visa stamped within couple of days of submission.

Hi All,

I am in a similar situation. My I-94 is valid until 10-08-2024, but the visa stamped on my passport expires on 09-30-2024. I applied for my H4 extension today 10-1-2024 after 1 day of visa expiry using Form I-539. I have a few questions:

  1. Did I apply for my extension before or after my visa expired, considering the visa expiry date for USCIS purposes?
  2. Will there be any issues when reentering the USA?
  3. What could be the possible outcome of my application?
  4. My receipt number starts with MCT, but I am unable to find it online as I filed my extension online. How can I check my status?
  5. Sending india and stamping and come back or i can stay legally in USA as applied form i-59 extension?

You should be fine as you applied before current i94 expires. No need to worry.

Hello,

I(H1B) and my wife(H4) have valid visa and i94 till May 2025. However, my 6 year old daughter(H4) has her i94 expiry date as 18 Nov 2024 due to old passport expiry date. We renewed the passport and are in process of filing the extension.

My question is what happens if H4 extension for my daughter is not submitted and received by USCIS before 18 Nov. What if it is delayed by 3-4 days?
Does 180-day rule applies to minor as well?

Everything applies to child as well.

You should file it online to make it quick if you don’t have time to file paper application.

Actually our applications are being submitted by employer’s attorney. I am trying to get i94 extended at Canada border over weekend. Hoping for the best.
