How to do I-94 extension or renewal after new Passport renewal in US?

Need your Advise, Please Help
Here is my case,

  • Have valid H1 Visa until July 2021
  • At US POE got a stamp with date Aug 2019 as per my Passport Expiry Date.
  • Renewed my passport after that
  • After that did not check my I-94 date, now it is expired for over a year
  • Applied H1 Extn with NPT
  • Got RFE
  • Attorneys are asking me to go to CBP with current I797 and ask for updated I94

Please let me know if it is safe to go to the border for I-94 to get mine updated

You can try but usually they would need visa stamp in your passport.

I have a valid stamp in my old passport until July 2021. Will they ask me to cross the border or can i get it done without crossing.

Hi Rohit, my i94 is now expired over a year also. I renewed my passport in May last year and did not know that I had to renew the i94 separately. My lawyers filed for the extension on h1b npt and that got approved by the extension of stay got declined. We appealed the decision by filing i290b MTR and that was rejected recently also. I am very confused and the past 8 months have been very stressful. Any feedback from you would be appreciated as to how you resolved your case.
