Maxout times clarification

Hi,

I expect my i-140 to be approved by June/May next year.
My 6 year max out happens to be Feb 2023 :wink:

Question 1:
IF H1B visa time is FULLY UTILIZIED

  • Should I need to wait for 1 year to return back to USA, even though i-140 is approved?

Question 2:
If the answer is “YES” to Question1, I am planning to leave USA early.
What should be the ideal time, would 2-3 months be enough time to get the counselling done and come back to USA?
