Old H4 extension Denied and New one is approved

My son (minor) has valid visa till 05/08/2022 but he got i94 till his passport expiry date that is 07/07/2021. We renewed his passport and applied for h4 extension on 07/02/2021
I had applied for H1 B transfer along with H4 on 08/01/2021, Both H1 & H4 got approved validity from 08/01/2021 till 07/06/2023. Today we came to know that my son old H4 extension got denied. Waiting for denial letter. How can we cover his 23 days illegal stay. Would it be a problem for my green card processing. Please let me know.

So you mean to say, your son’s H4 extension of status that you applied with your H1B transfer was approved from 08/01/2020 to 07/06/2023?

Are you referring to your son’s application for extension of status that was applied on 07/02/2021?

During the 23 days while his extension of status application was pending and the I-94 expired (from 07/07/2021 to 08/01/2021), he will be considered in a period of authorised stay and so if that application was denied now, I don’t think it will create any issues with your green card process or your son’s status.

Below is the reason for Denial.
USCIS records and your from I-94 arrival and Department Record, show that your were admitted on feb,08.2020 as a(n) H-4 nonimmigrant that you were granted an authorized stay until June,07,2021 You are requesting an extension of stay until May,08,2023, but you will still be in status at that time, You were granted a period of authorized stay until Jun 26,2023, on approved form I-539 (LIN219XXXXXX) Therefore, the application is denied. Please note that this decision is an administrative procedure to close out the case and the decision does not affect your current nonimmigrant status.

I think no need worry about 23 days gap.

Yes, as I mentioned the gap is considered the period of authorized stay. USCIS denied duw to already approved EOS application, so no need to worry.
