Unpaid wages and leave applied

In the past, when I was on bench, employer did not pay me for few weeks.
Later they asked me to apply leave for those period.
Can this be reported to DOL WH4 and claim back wages for those period even though leave was applied?
Has anyone else come across this scenario?
Should I be also consulting an attorney before reporting to DOL? Any pointers to attorney would greatly appreciate.

Was your payroll run for the bench time? If not, them how did you maintain the H1B status?

They did not run payroll. Probably that’s why they asked me to apply leave.

You are considered out of status if your payroll is not running while on H1b visa.

If you did apply leaves yourself, then how can you claim that they did not pay you?
