221G - AP (1 year) - Sponsored by end client in Canada

Hi! Please help me with the situation as I’m completely stressed.

I have been on 221G consular h1b processing for over a year. 6 congressman inquires with a generic response from the embassy and I sent around 15 emails requesting status updates for me but no response.

Finally, I convinced the client my manager to sponsor me in Canada as H1b with the client wouldn’t be possible due to the existing 221g. Upon joining the client in Canada now the embassy has requested to submit client docs, paystubs, proof of vacancy, etc. which I wouldn’t be able to submit. Please let me know how to respond to the embassy. Employer is not helpful in my case and I don’t rely on them to respond to my request. I want to resolve this with the embassy so future petitions don’t face any scrutiny.

Please respond with your expert opinions.

Please help with your expert opinion.

If you don’t submit the documents that embassy has requested, the visa officer might deny the visa.

The H1B job has to exist and the H1B sponsor employer should be able to offer the job at the time of visa approval.

You can apply for a fresh visa stamp or submit the new H1B employer 's documents. The visa officer may grant the visa based on current H1B employer 's documents

Thank you for your prompt response. At this time I’ll reply saying I’m unable to provide the requested docs. Rest is up to the officer’s discretion.

Can I apply for a B1/B2 when it’s pending 221g? Or do you recommend replying to the embassy to decide on the current 221g and then applying? Please advise.

You can apply as many different type of visa as you want at same time.

This is a great relief. Thank you!
