Almost turning 21 while I-130 Green card application is pending

Hello, I submitted my Form I-130 Petition for Alien Relative on May 5, 2017. I will turn 21 on Dec 2. I checked the USCIS processing times and it says they are on April 6, 2017. how likely would be the case be approved before I turn 21? Or should my age even be considered since they already received my case??

Thank you!

You should be able to get your I-130 application approved before you turn 21. Do not worry.

On the other hand, if you turn 21 before your I-130 is approved, you will lose the opportunity.

In other hand what about the Child status protect Act (CSPA) ?

The child protection act does lock the age but its based on various factors.

I answered simply on the basis of limited information that the person shared.

The age is locked if the sponsor is a US citizen.
And the rule is different for sponsor if he is a green card holder. There are age calculations involved in that case.

thank you Anil
regarding age calculations now i become 24 how much time should i wait to go with my family

Hi @saadat

I cannot estimate the approval timings. They all vary with country and US embassy.
