Hi everyone, I’m currently on F-1 STEM OPT and recently filed Form I-539 online for a change of status from F-1 to H-4. My I-539 is currently pending and I have an IOE receipt number.
My spouse is currently in H-1B status, and her EB-2 NIW I-140 is pending with premium processing. Once her I-140 is approved, I should become eligible to apply for an H-4 EAD under I-765 category (c)(26).
I recently noticed that if I-539 and I-765 were not filed together, the later I-765 would be treated as a standalone C26 application rather than “C26 filed with I-539 H-4.”
This matters because the current USCIS processing-time estimates I’m seeing are roughly 6.5 months for C26 filed with I-539 versus 17.5 months for standalone C26.
Because of this, I’m considering two options:
Option A: Keep my currently pending online I-539. Once my spouse’s I-140 is approved, paper-file I-765 C26 separately using the pending I-539 receipt. The downside is that the I-765 would apparently be treated as standalone.
Option B: Withdraw my currently pending online I-539. If my spouse’s I-140 is approved while I am still within my valid F-1/STEM OPT period, paper-file a new I-539 + I-765 together as a concurrent H-4/H-4 EAD package.
A possible Option C: Keep the current online I-539 pending until the I-140 is approved, then file a second paper I-539 together with I-765, wait until USCIS accepts/receipts the new concurrent filing, and then withdraw the original online I-539. This would potentially avoid withdrawing my existing timely-filed COS before the new application is accepted.
Has anyone been in this exact situation — online I-539 already pending, followed by either a separate I-765 or a new concurrent I-539 + I-765 filing?
In particular, I’d really appreciate experiences regarding:
- Whether anyone successfully withdrew an online I-539 and refiled I-539 + I-765 concurrently;
- Whether anyone had two I-539 applications temporarily pending, then withdrew the first one after the concurrent I-539/I-765 package was receipted;
- Any status/COS issues caused by doing this;
- Actual H-4/H-4 EAD approval timelines if you did something similar.
I’m especially interested in recent 2025–2026 cases, since USCIS processing patterns appear to have changed significantly.
Thanks!
