Am I eligible for AVR to enter US from Canada when dropbox appointment in India is scheduled for future date

Hello,

Please assist with this urgent request.

I am Indian citizen. Planning to travel to Canada for a week to activate my Canada PR.
I learnt that I will be eligible to use AVR since I am only travelling to Canada for less than 30 days with expired US visa but valid I797.

However, I have US stamping appointment scheduled for 2023 at Delhi, India. Am i still eligible to use AVR to travel between Canada and USA? AVR rule says, nonimmigrant is not eligible to AVR if “Applied for a new visa which has not yet been issued;”.

Any leads and help would be highly appreciated. Thank you.

This applies once you appear for visa interview. I dont see any issue in using AVR.
