As EAD 540 days auto extension is cancelled, is it ok if I apply my h4 EAD more than 180 days before the current expiration(August 2026) as my latest h4 extension -I94 is valid till August 2028. I am afraid it may not approve in 180 days hence want to apply sooner to avoid employment gap.
You can apply but sometimes they return the application with the reason that you applied too early.
Thank you for your prompt reply Anil. Do you know if they will return immediately and anyone have faced it before. And if you know if anyone have applied and got it done. What if they don’t return before it reaches 180 days window? Do you think I should file another request if they don’t reply/return on 180 days mark. Please suggest if you can.
