Change of status (COS) to H1B

I have a situation & need your suggestion here.

I am currently in US on L2S & working.

My employer, filed H1B, lottery got picked up & even got my approval for the same, but now when i see my 1-94 online, it still has L2s status.

My question is, i would like to push my H1B start date (October 1st 2024) to a later date. would it be possible to amend my current petition & request for Consular processing instead of moving to H1B starting October 1st 2024.

I am in a situation where i want to extend my current status (L2S) for few more months & want to know my options here.

You will need to file L1 COS if your H1B COS has already been approved to start on 1 Oct.

Thanks for the response.

Its L2, not L1.

I have my L2 visa valid till May 2026, do i still need to apply for COS if i make an amendment to my existing H1B approval to switch to consular processing instead of change of status.

As of today, my H1B is approved & activation still dint happen, guess it would come in to effect on October 1st 2024, before to that i am planning to amend & switch back to my current L2 Visa.

Please advice.

I don’t think an amendment can cancel the already approved H1B COS.

Talk to your employer’s attorney to get their view point as well.
