Clarification Needed on H4 EAD, 540-Day Extension, and Impact of H1B Transfer Status

Hi Anil,
I’m in a tricky situation. My spouse’s H1B transfer was filed in premium in March, and my H4 and H4 EAD were filed concurrently. An RFE was issued, and the H1B is still pending even after the RFE response. My current H4 EAD and I-94 expire on June 19, 2025. I have a few questions:

  1. I’ve received the H4 EAD receipt—am I eligible for the 540-day automatic extension?
  2. My spouse’s current employer is filing an H1 extension in regular processing. Should I file H4 EAD again with it, or would that be redundant?
  3. If the H1 transfer is denied, what happens to my pending H4 and EAD?
  4. If I reapply for H4 EAD with the H1 extension, can I file it separately (not concurrently)?

Looking for guidance to ensure I can continue working. Thank you!

  1. No, not eligible as you need H4 approval for auto extension of EAD.
  2. It will be redundant.
  3. Most probably H4 and EAD will be denied if H1B transfer is denied since the basis of those applications was this H1B transfer.
  4. Yes, you can file H4 EAD separately.
