Co-worker affidavit only for i140 application

Hi @anil_am22,

I am in the process of filing i140 and don’t have any experience letters to provide, but I am submitting one co-worker exp letter affidavit. My que is,

  • Would i get an RFE asking to provide exp letter? If yes, then my previous employer doesn’t provide exp letter or letter explaining why it cannot provide it, then in such case how do we respond?

  • One exp letter affidavit would suffice? Also, do we need to mention that the co-worker is no longer working with the same employer?

Has anyone got an RFE for the same, please share experience. Thanks!

If I could guess the RFE, I would have made millions by using that super power

@anil_am22 thanks for replying :joy:
I was generally asking if you had encountered such case or has anyone got an RFE for the same and would like to share his/her experience.

If your employer has a policy of not providing the skill letter, then you have no option but to give the co-worker’s letter.

You can work on the response if you get an RFE based on their request for clarification.

Till then, everything is just speculation.
