DS-160 Disclosure question

Asking for a friend, he had a traffic incident last year and was charged with misdemeanor for speeding 91 on 55 limit. He hired an attorney and got the misdemeanor amended to an infraction for IMPROPER DRIVING. He needs to answer the below question in DS 160 form for scheduling the visa stamping.

“Have you ever been arrested or convicted for any offense or crime, even though subject of a pardon, amnesty, or other similar action?”

What should he answer to this question? "Yes"and provide the information including the paid fine and amended charge document during visa interview, if asked? Or should he answer “No”.

Is he answers “Yes”, then I believe every time he fills DS 160 for visa renewal, he will have to answer this question as “Yes”. Is this correct? Please advise…

You can answer ‘Yes’ and provide the details.

There is no clear way of knowing if this will affect the visa processing or not.

But, in most cases that I know of, a driving traffic ticket (even if no arrest) has a high chance of getting DS-5535 or form 221g.

In that case, does it means, every time DS-160 form is submitted for visa renewal, he has to answer “yes” and go through this dilemma of potential 221G/DS-5535?

Ya… Even if you answer no, there is a good chance that background verification will prompt a check and they will issue a form 221g to submit details.
