EB1 priority date movement

Hi Anil,

Our I140 approved in December 2018 . Our Priority date is October 2018 in EB1 category. Any probability that EB1 priority date moves from October 2017 to current ?

There is a possibility that EB1 may get current in Oct 2019 visa bulletin.

I saw the priority date moved to March 2017 . Any chances of EB1 categories moving to current.

Thanks for replying. One more advice please. I am following table " DATES FOR FILING OF EMPLOYMENT-BASED VISA APPLICATIONS" in VISA bulletin for filing AOS as my L1A is running out by mid-2021.
Do you think my PD (7th May’ 2019) will be eligible in near term to file for EAD/AOS? What’s your estimated date?

If you are an Indian, then chance of May 2019 getting current are low in next 4-5 years.

Yes I am an Indian. But my question is , will I be atleast eligible to apply for I485 in near term? So that I can continue my stay in this country legally even after L1’s 7 years gets completed before my GC finally comes.

You can only file i485 if your PD date gets current in either ‘final action’ chart or ‘date of filing’ chart. i do not think that ‘Date of filing’ chart, which moves faster than ‘final action’ would be current anytime in next years.

This is just my estimation based on publicly available data. The actual movement may be different. I suggest to keep a watch on monthly USCIS visa bulletin.

@Anil.Gupta What’s your gut feeling about “Date of Filing” date movement for EB1C. Your prediction about my i140 was pretty accurate earlier…thanks. That’s why I am asking what do you feel about “Date of Filing”?

Hi Anil ,

As per Latest visa bulletin EB1 moved to July 2018 & our filing date is October 2018 . Pls help suggest if we can initiate FBI clearance & State police along with home country police clearance process now or wait till date become current.

Police clearance certificates may or may not be required for your specific case.

Talk to your attorney and they will tell if you should submit them or you can skip them.

Any predictions on October Bulletin as our priority date is October 2018 . Also just checking if form I 693 to be filed along with 485 or can be submitted when interview is scheduled.

Hi Anil ,

Pls suggest on this as our priority date is oct 2018 in EB1 category we have filed for 485 this month along with EAD & AP card . As per November bulliten the final action dates moved to Dec 2018 so will we still hv to go through EAD & AP process or will be directly considered for GC process . If so what will next steps pls suggest.

I have been following your site thanks for your timely responses . My query is we have filed for 485 in October 2020 in EB1 category. I’m derivative applicant & my client now offering me Full time job so pls suggest if I can change employer while our 485 is in progress.
