My PD under EB2 is Feb 8th 2012. Prior to Oct Bulletin I was working with my attorney to file for EB3 Downgrade. Now since DOF for EB2 moved to July 2012, I can now submit my application for AOS under EB2. But, my attorney is still suggesting me to go ahead and file for EB3 Downgrade. I am very confused. Can you or anyone in same situation suggest to me what to do? Thanks for your help in advance.
There is no harm in filing the EB3 i140 downgrade in parallel to filing i485 using EB2 approved i140.
That way, you will be able to use EB3 queue if it stays current and EB2 retrogresses.

That is correct, the earliest USCIS can receive the application is 1st December.
Based on CHarlieâs Oct youtube call, he does not predict EB3I to move at all in 2022 (of atleast until 2nd half of the 2022). Your estimates for EB3I is still moveing to April in Jan VB. What is the logic?
I am not sure why are you giving false hope to EB3 folks. It certainly wouldnât move at all this year.
There is no hope for EB3 as well as EB2 either.
The EB2/ EB3 prediction on your page shows that EB3 may not reach Jan 2014 in 2022.
However your EB3 prediction table shows that date will reach Feb 2014 in Jun 2022
and EB2 will reach Jan 2014 in Jul 2022
