EB3 I485J/TUB request

My initial I-485 was filed under EB2 (PD: Jan 2013) in 2022, but my case moved to CRP due to retrogression. I became eligible to file an I-140 under EB3 in October 2024 (as per the filing date chart), and the Final Action Date (FAD) became current in March 2025. I submitted my I-485J (TUB) and received an RFE for medicals, which I responded to.

However, today my case moved back to CRP status. I contacted Emma, and she mentioned that USCIS has not received my TUB case, or the officer has not attached my EB3 TUB case to my EB2 AOS case. Since I am not current in EB2 according to the visa bulletin, a visa is not available.

I have not changed my job, so the I-485J TUB is redundant. It has been more than 15 days, and I have not received my I-485J receipt. How can I convince USCIS to consider my case under EB3 when they have not processed or attached my EB3 TUB case to my EB2 AOS case?

How did you send the TUB request? Did you file with an attorney?

Ask them about what happened in other such cases that they have filed.

You must have its receipt and proof of delivery to correct address.

Yes my attorney filed TUB request. They are asking to wait for 8-10 weeks for supplement receipt notice which will poses a risk for retrogression or exhausting the visa numbers.

Unfortunately, there is no way to expedite it. You just have to wait for them to read your TUB request and take action.

So seems like they did issue my I485J receipt now but not sure if they can take the action immediately? What are other way to trigger them to take an action?

I just received my I-485J receipt today. I’m wondering if it’s okay to send a new medical to the same officer who reviewed my case last time, along with the I-485J receipt. Would that help, or could it cause more confusion?
