I am on F1 OPT. Enter US in 2018 on F1. I am filling up I 539 form for myself. My sister back in 2019 applied for I 130 Immigration petition for Alien Relative.
filling I 539 , I have concerns about these two questions:
Part 4 Item Number 3. Are you, or any other person included on the application, an applicant for an immigrant visa?
I never applied an immigrant visa [ I 130 is a immigrration petition] .So I concluded this would be “No”? Is that right assumption?
Part 4 Item Number 4. Has an immigrant petition EVER been filed for you or for any other person included in this application?
I believe this should be “yes”.
Question:
Is it possible that answering yes to Part 4 , Item Number 4 Question Has an immigrant petition EVER been filed for you or for any other person included in this application? could lead to H4 denial? Or Am I overthinking here.
