H‑4 Extension Pending, I‑140 Approved Later, Filing H‑4 EAD Now

Hello,

My situation:

H‑1B + H‑4 extension filed in June under premuim processing

H1-B approved within 15 days

H4 RD is 23rd June

H‑4 extension is still pending

I‑140 got approved in September and got the approval notice

I filed the H‑4 EAD (I‑765) on Sept 15th based on the approved I‑140

Would this be treated as standalone(17+ months) or they will tie up to the pending h4 extension(6.5+ months)?

Is your current H4 i94 valid?

H4 EAD will be considered standalone.
If you sent your pending H4 details with your EAD application, then, they should consider it.

H4 i94 is valid till 20th Sep 2026 and H4 extension is still pending with RD 23rd June 2026

I did sent pending h4 receipt notice with a cover letter requesting to tie up to the pending h4 extension.
