H-4 visa valid but I-94 expired for 90 days now…just found out yesterday as my spouse changed employer and employer missed filling an h-4 extension?

We found out that I-94 expired in May 2025 and it’s 90 days now..and as my spouse changed employer and didn’t file H-4 extension..and finding that I’m out of status..what’s the best option file an extension with NPT or leave US?? Please advise. @anil_am22

Hello Amit, have valid H1B visa until august 12 2025 and an I-797A extention approved until Aug 12 2028. when i went to take latest i-94 records from i-94 website it still shows me August 12, 2025 as admit until date and not the I-797A approval date. Past weekend we went to a closed loop cruise ship from Galvesnton to Cozumel via Royal Carribean . after coming back the latest I-94 date mentioned as enetered on August 4th and admint until Aug 12 2025 and not 2028. so went to deferred inspection office today to make the correction to make sure that the date is extened until 2028. the officer gave feedback as “The officer explained that the I-94 record on the CBP website—or the most recent I-94—will continue to reflect the date stamped on my visa, even after the approval notice.He also clarified that the USCIS notice takes effect starting August 12th, as indicated by the I-94 information on the I-797A document. Since the I-797A is issued by USCIS and not CBP, the I-94 dates on that document remain valid.”

how accurate this is and do i need any additional care to be taken ? Does crossing border fixes the issue or deferred inspection site is the only option. can any paperwork can handle this ?

if you don’t have strong reason don’t apply NPT.
we applied recently and it got denied.

If the new i94 starts Aug 12, then, i believe, you should be fine.

But, since this is a matter of H1B and H1B is held by employer, i suggest to keep your employer informed about this.

Thank you appreciate your feedback. I will keep employer and attorney informed. I feel i should be safe but wanted to have my options ready as i am running out of time.

Do you think its a good idea to travel to Laredo , cross the border as explained in one of your article and get I-94 in line with I-797 dates ? On August 12th Visa is expiring , Latest I-94 expires that was issued after cruise travel, Approved I-797 comes into effect. What’s the possibility that they allow me to come in with above situation as deferred inspection site at said they cannot fix my i-94.
