H1-B extension - 7th yr question

Hi Anil,

I’m currently with employer ‘A’ in my 6th year of H1-B (maxing out this August) and another employer ‘B’ has filed my PERM last year, before the end of 5th year of H1-B.

So, I’ve heard that the employer ‘B’ while initiating my H1-B transfer, can also file for 7th yr extension since my PERM was filed before the 6th year. Is that right?

Also, with some new rule, I can request for H4 extn and also the H4 EAD along with this? Is that true?

If I do my h1-b transfer (cum extn) in premium, will h4 extn and h4 ead be also taken care of? How do I handle this?

H1B extension PERM after 6 year is allowed in 1 year batch if PERM is pending for 365+ days including PERM audit days. PERM has no premium processing.

H4 EAD eligibility: i140 is approved or H1B 7th year extension applied with PERM. H4 physically in US. Cannot be filed from India. Job offer not required.
