H1 to h4 while h1 on admin processing

Hi,

I currently have an approved h1 petition but when I went for visa stamping I had received a pink form 221g for client letter; it’s been more than 7 months and I wanted to apply for a h4 and enter as a dependent as I have to get back to my family. When I’m trying to fill the ds 160 for h4 application, I get a question “Present work/Education/Training Information”. I’m confused what to answer here because my h1 is currently under admin processing and I don’t intend to work if I apply and receive a h4.

Should I select “homemaker/ unemployed” or do I have to mention my current employer name as present employer?

  1. If homemaker/unemployed, then I’ll have to put an end date for my employment with my current employer which I’m afraid might jeopardize my h1b application that is in admin processing as I assume that would need continuous employment with the employer that filed the petition until a final decision has been made on h1b admin processing.

  2. If I enter my present employer details and mention as current employer, then I fear they might think I’m using h4 as a back channel to get into usa and start employment and reduce my chances of getting h4 or have h4 also in admin processing?

Can anyone please help me if they have encountered same or similar experience or if aware of this issue? Thanks in advance

I suggest to write the truth.

For H4, you will tell them you don’t plan to work until you have the valid work authorization.

Thanks @anil_am22 i know it’s better to call the vfs customer care number but they are not helpful, hence asking you if you have heard of a similar case and how they went forward with the h4 application.

I’m applying for h4 as dependent on my spouse as my h1 is under admin processing.

So can I close and start the application in the us visa scheduling website and if I do close the costing application would that mean I am withdrawing or closing the pending h1b that is currently in Admin processing? Or is that independent?

Also, last question in regards to the pending h1 application I got a pink form initially for client letter/msa but in the emails received by my employer they only asked for the vendor details and some other employment questions but not about client letter. So can I do a walk in and present these docs or contact kccfpu for submission hoping to fasten the process?
