H1B Approved but No Approval Notice After 60 Days – Status Confusion & H4 Options

Hi, @Anil I need guidance regarding my current visa status and next steps:

  • I was on H4 status (valid until 2028).

  • My H1B (Change of Status) was picked in the lottery last year (2025).

  • My H1B petition was approved on February 12,2026.

  • However, I have not yet received the approval notice (I-797).

  • It has now been more than 60 days since approval.

Current Issues:

  • I am unable to join my job because I don’t have:

    • The approval notice copy

    • SSN (cannot apply without proof of status)

  • I also cannot apply for a change of status back to H4 because I don’t have the H1B approval document.

  • my questions are………….

  1. Am I currently considered to be on H1B status, since it was filed as Change of Status?

  2. Can I switch back to H4 now, even without the approval notice?

  3. What are my available options at this point?

  4. I am feeling stuck due to lack of documentation any help is greatly appreciated.

Has your attorney contacted USCIS to get a copy of i797 approval?
What action have they taken?

Yes , attorney raised an enquiry for non-receipt of the approval notice has been initiated 25 days back. Still no response from uscis
