I would really appreciate inputs on my current situation summarized below.
H4 COS application got approved couple of days after H1-B COS approval. I am already working with attorneys on next steps but posting here to understand the experiences of folks who faced similar situation and what steps were taken to retain the H1-B work authorization. I would really appreciate sharing the experiences.
Timelines:
-
Jan 26: Last day with old employer (lay-off)
-
Feb 4: H4 COS and H4 EAD filed, no premium processing. Status updated to Received by USCIS
-
Apr 16: New Employer filed H1-B COS in premium processing
-
Apr 24: RFE on maintaining of status
-
May 8: RFE responded
-
May 11: H1-B application status changed to clock stopped
-
May 22 Morning: H4 EAD status changed to new card being produced
-
May 22 Evening: H1-B application approved
-
May 22 Evening: H4 application is still showing Case received status
-
May 26 Morning: H4 application approved.
My queries:
- If H4 and H1B have the same start/effective date, what would be my status?
- If H4 effective date is newer than H1B, what are my options to retain H1b approval? My previous visa stamp is expired so travel for stamping is not an option I am considering.
