H1B Extension and Amendment while travelling

Hi,

My current visa stamping is valid until Jan/2025 and I moved to a different state few months back due to change of client and my employer hasn’t filed for amendment yet as they wanted to do it together with extension.

I was planning to travel to India in Oct so wanted to ask,

  • Is it ok to travel and return and then start the extension/amendment process?
  • Or recommended to file the extension/amendment now and while its in process, I can travel and come back?
  • I ll return within a month so back by Nov so since the validity expires in Jan is it ok to return back with 2 months left in visa.

I would file amendment asap. Per the USCIS guidance the employer is required to file amendment before the employee starts at new location.
Consult your employer’s immigration lawyer to discuss the best approach for the amendment questions you have.
Re: entering the US with short visa validity is totally fine. Your visa should be valid the day you enter the US is what matters and it may expire the next day, totally fine.
