H1B Extension RFE

My current H1B extension was issued on Jan-2022 and petition valid till Feb-15-2025 and my i94 is valid till 02/26/2025.
In Jan-2023, location change & promotion amendment was filed and approved in Apr-2023 with same as above date and i94.
Now in October 2024, my H1B extension filed again which is in RFE state now. And my company is preparing to respond RFE by Jan 1st week. I have below 3 questions.

  1. Let’s say after RFE response case denied on 01/15/2025, can I continue working and stay in country till i-94 expiry date.
  2. Can my company file another petition before i-94 expiry immediately or they need to wait few days for me to continue working past i-94 date.
  3. Does upgrading to premium while sending RFE response a good idea or it will increase risk to my case.

You can work using the approved amendment and per the job role mentioned.

Your company can file another H1B amendment or extension immediately.

Could you please share your opinion about my 3rd questions? I am in dilemma whether I should push for premium or let it be regular, considering change in govt. from Jan 20th.

I have always been in favor of premium if you or employer is ready to pay for it.

Change in government may bring some surprises. So, it is better to get peace of mind than living in fear.
