H1B H4 and EAD bundled in premium after January 18 2025

  1. My employer filed H1extension, h4 extension and H4EAD extension together in premium processing. My H1 b is approved waiting on H4 and EAD details.
    Since these were file after the Edakuuni settlement expiry date, I do not expect H4 and EAD to approve immediately, but i do want to know how much time it is typically taking to get both approved now a days. Company attorney says “While the H-1B receipt was issued promptly under premium processing, the H-4 and H-4 EAD receipt notices typically take longer to arrive. The good news is that once receipted, these cases are currently being approved quite quickly”. I do not have a timeline as their words are quite subjective.
    My spouse has EAD validity till October 2025 not sure if that is sufficient time . Please suggest.

  2. Please also advise if my spouse can qualify for 180 days automatic extension for EAD as H4 and EAD both were filed in timely manner (before expiration)?

You need H4 to be approved to be eligible for EAD auto extension.

I would appreciate if you can throw some light on the current trend (my question 1.)

I have a follow up question-
So for my case where my current visa is valid till October end 2025. And the new H1 extension( approved last week) is valid from November 2025 till October 2028.
Now if I already filed for my spouse H4 and EAD( in time), and let’s say H4 gets approved in 1-2 months and EAD still pending, my spouse would still have an automatic EAD extension for next 180 days. Please confirm.

The auto ead extension time counter starts from the day the previous EAD expires.
So, you should be able to use the EAD auto extension if H4 gets approved and EAD stays pending upto 540 days.

Thank you for sharing this info. Were there H4 and EAD approved simultaneously or it took week time after H1and H4 for EAD?
