So I was laid off and I starting working for a company A on receipt, and my H-1B transfer with them is still in pending status. Recently, I received a offer from another company B, and they’re planning to file an H-1B transfer in premium processing. I do have i94 validity till 2027
I wanted to check with the community:
Does the new employer B’s H-1B transfer typically get approved even if the current petition is still pending? Or does USCIS usually expect the company A’s H-1B petition to be approved before approving the new transfer petition?
Has anyone gone through a similar situation, and did you receive an transfer approval or an RFE or something not possible?
Any insights or experiences would be really appreciated. Thanks in advance!
Thanks a lot @anil_am22 appreciate it that helps.Yes grace period was not violated and did start working for company A within 60 days. So just to understand more is this even called bridge petition? And say once Company B’s H1B is approved I can start working for them and after that in future Company A withdraws their pending H1B petition that should not cause any issues in future.
@alphy_k did your employer B petition got approved?
I am also in a similar situation where my new employer is filing petition this week and my current employer petition is pending? I do have valid stamping and my i-94 is valid and also started my job within grace period.
