H4 and H4EAD Extension

Hi,

URGENT !! Writing this post to get a little clarity on my situation and determine the path forward.

I was on H1b until December 2022 and got Converted to H4 in February of 2023 along with H4 EAD that is valid till 30th September 2024. My Husband filed for his H1B extension along with my H4 extension and H4 EAD extension in April of 2024 (6 months prior to his H1B expiration date) via normal processing which is still under processing. I have received my H4 extension receipt notice in June of 2024. Therefore my questions here are:

  1. Can i work on my H4 receipt notice beyond the expiration of H4 EAD which is Sep 30h 2024.
  2. Am i eligible for the automatic extension of 540 days since i received my H4 receipt notice already and filed for H4 and H4 EAD extension in a timely manner.
  3. Will filing for a premium on my husbands H1b extension guarantee processing of my H4 and H4 EAD prior to September 30th.

There is no guarantee of getting all 3 approved at the same time if you upgrade your H1B to premium. They do it as a courtesy.

Oh damn. I do not have a valid h4 I-94 since i haven’t travelled outside US after COS to H4. But how does that clause even make sense, aren’t both the I-94 and H4-EAD issued based on the H4 validity. So, if i do have a H4 I-94 it would have still expired on Sep 30th of 2024 in which case i cannot produce that to be eligible for auto renewal.

Also, since i do not have a valid I-94 i am not eligible for the auto renewal. So what are my options here to continue working past Sep 30th 2024 which is the day my H4 EAD expires ?
