H4 EAD gap between old and new cards

Hi,

Below is the scenario

H4 Old - Valid from 04/01/2022 to 03/31/2025
H4 EAD Old - Valid from 05/19/2022 to 02/03/2025

H4 New - Valid from 04/01/2025 to 03/31/2028
H4 EAD New - Valid from 04/01/2025 to 03/31/2028

There is a gap of 2 months in between old and new EAD.

Has anyone had this issue before?

I have sent my new EAD card along with documents to USCIS for correction, but I’m not sure how to track the request. Will the case status of new H4EAD gets updated upon the receipt of documents by USCIS?

To not lose my employment can I file a new I-765 application and will I be eligible for auto extension?

You should be able to get EAD auto extension as you have approved H4 i94, if you file a new EAD application.

Hi Anil,

Thanks for the quick response, I spoke to lawyers they are not recommending to file a new H4 EAD.

Also spoke to USCIS tier 2 officer they are suggesting to file for correcting the dates rather than filing a new application.

I have sent the documents to USCIS for correction.

Quick question, my spouse also at same situation. What about the employment eligibility for the period of gap, when the EAD card is sent for corrections ?

According to lawyers and I 94 compliance not allowed to work during the gap. That’s what we were told.
