H4 EAD renewal and travel abroad

Hello,

My wife is planning to travel to India next week for 3 weeks. Her H4 extension already approved and awaiting the approval notice. She already has a valid stamp till 12/2025 so won’t be renewing the visa this time. She is currently employed and H4 EAD is also valid till 12/2025. I have couple of questions here.

  1. Can she apply for H4 EAD extension now and can travel or is it better to apply for EAD extension once she is back in the US?

  2. As she is not renewing her visa based on the recent H4 extension, is there any possibility that immigration officer can issue the new I-94 based on the current visa stamp which has validity only till 12/2025. If that’s possible is there a way to get the I-94 updated to reflect the new expiry date based on recent H4 extension which is valid till 6/2028.

  1. She can apply H4 EAD now and travel.
  2. Yes, it is possible that they give shorter i94. Just make sure you explicitly request them to match it with H1B validity dates. They will do it.
