My wive’s H4 extension got approved but NPT is denied as i94 is not backdated.
H4 expired on 09/01/2022 and new H4 is valid from 01/15/2025 to 12/28/2027 and H4 EAD is granted the first time from 02/01/2025.
Currently she has a gap more than a year leading to 10 yr bar if travelled outside of USA, can we file MTR for NPT again? or she has to go to US consulate at home country and file waiver which takes 2-3 yrs!!!.
H1B holder myself maintained proper status throughout.
If they approved H4 extension, then i think you are safe.
The only thing is that whenever you go out for H4 visa stamping, you may be asked to explain the gap.
So, keep all the proofs of H4 extension approval and NPT request for future.
If you want to be on absolutely safe side, you can try going out now and apply for H4 visa stamp and re-enter USA. I do not think it is required though.
Got it, but travelling outside of USA means it triggers a 10 year ban. And to rectify it it takes atleast 2-3 yrs provided the waiver gets approved.
Is there any way i can rectify when i am in USA.
Do you have any updates on this , My wife is also in a similar situation on her H4. any update will help.
