H4 Extension for child alone a duplicate while there is an existing H4 extension pending

I have applied for an H4 extension for my spouse and child (I539 and i539A) in Nov 2024 and is still pending status. However my spouse had to leave the country on a family emergency and came back with a stamped visa.

When checked with my attorney they mention , uscis could abandoned the extension. if they do so i have to refile. so I thought to file a duplicate to avoid complexity.

Now I am planning to file another new H4 extension for my dependent child above 14(Current h4 is valid for some more days) . I have some questions in this regard.

Question 1)

While providing supporting documentation,

Should I also Include my spouses’(H4) passport ,visa and I-94 as well ?

Question 2)
Planning to Include a Cover letter should I mention the current pending extension receipt # of the child and spouse and the mention reason we are applying duplicate.

Your child’s H4 details like passport and i94 would be required, not your spouse.

You can add a cover letter explaining the situation.

1)Can I write the cover letter or it is from the applicant child.
2)Planning to send below documents along form and fee. Please let me know if I am missing any?
a)Child’s: passport,i-94,visa ,current H4 approval(have few days validity) ,birth certificate.
b)H1B primary’s: Passport,I-94,visa , latest H1B approval, stubs.
3) I think it is not required to send current H4 Extension receipt (which i think going to get abondoned)
