My current H1B, spouse’sH4 EAD, H4 all expire on 10/10/2024. We filed for H1B, H4, H4 EAD extension concurrent processing on Aug 27th 2024. I was earlier of the wrong understanding that my spouse on H4/ H4 EAD can continue working beyond 10/10/2024 assuming 180 day automatic extension rule would apply, but realized now that it is not applicable in our case. Therefore, we are going to file for premium processing in 2 days. Below are my questions.
- Once H1B extn under premium processing is approved in 3 weeks (15 biz days) , would the H4 extension also be adjudicated/ approved around same time as both are filed concurrently?
- Assuming H4 is not approved along with H1 B extension, we are planning to visit CBP office in San Diego before 10/10, to get extension of spouse’s I94 based on my newly approved H1B extn(which would be around 2-3 years). Does the CBP office allow for I94 extension of spouse H4 based on my new dates? Planning all this to save spouse’s job
