I got h4 stamped in India in April after my husbands h1 extension was filed. Traveled on Aug 30,2024 with stamp expiring on sept 30,2024. At the time my husbands extension was approved till 2027. My passport is also valid till 2027.
My i94 admit date is till sept 30,2024. And we did not file for h4 extension before that.
I am trying to get i94 corrected with CBP but not sure if the outcome.
Wanted to understand the best course of action if the CBP correction does not work out as I have not crossed 180 days. Will stamping be an issue?
In Ds160 while answering about unlawful presence should I just give the reason that the company didn’t apply for extension?
If I go with NPT what would be the best reasoning to give as there were no medical issues or other critical circumstances.

You should file for H4 extension immediately with NPT request.
You have to decide the reason behind the non-filing. Your husband’s company is not responsible for filing H4 extension. So, that reason is not a good one.

Also if I file npt am I not risking crossing 180 days by staying in the US in case of a rejection? (As I’m assuming, if I file for npt and leave before 180 days, the application will be canceled)
Also, I read the above link you provided. But that talks mostly about people crossing 180 days because as I understand, it becomes extremely risky for them to leave the US as they are seeing a possibility of a ban. And that won’t be the case for me if I left before 180 days.

If you read the article, it mentions that it is better to not cross the 180 day mark even if you filed NPT before 180 days.
Rest is your choice. I can only suggest.
@anil_am22 Thank you. I understand that. However I wanted to understand your thoughts on stamping instead as it’s a faster option too. I read on the other discussion thread on this site and people were getting suggestions for going and getting it stamped.
Also do you have any recommendations for good law firm to help with this?
