H4 to h1b conversion

Hi,

Kindly help me with below responses. My spouse is on H4 and her H1 is picked in lottery this year. My questions are if we go for Change of status from H4 to H1B,

  1. Will she be automatically be on H1 starting from 1-Oct?
  2. Does she need to go to india for stamping to be effective on H1B?
  3. H4 expires on 9-Sep-23 and extension is applied. If it gets approved after H1 approval - will she be on H4 or H1?

Hi @anil_am22 Thank you for sharing the link. I went through this and my first question is answered(Spouse will automatically move to H1B post H1b approval). Can you please help with answers to my questions 2 and 3? Thanks.

If you apply for H4 to H1B as change of status (and not consular processing), then status will change on approval and there will be no need to get visa stamp.

Whatever gets approved last will be the status.
