I-140 blocked due to company's past three years audited financial statement

My friend is currently employed with Company A but had his PERM processed through Company B. The PERM was approved on first week of June, 2025. However, Company B is reluctant to file the I-140 petition, citing the requirement to submit audited financial statements for the past three years.

  1. Is it mandatory for an employer to provide audited financial statements for the last three years when filing an I-140?
  2. Are there any alternative options to file the I-140 without submitting the audit reports?
  3. My friend has completed two years on H1B. Based on the approved PERM, is it possible for his spouse to apply for H4-EAD?

Financial records of the company are required to prove that company can support all the i140s that the company has filed.

H4 EAD needs an approved i140.

If my current company has filed the I-140, is my employer still required to submit financial records?
