Hi,
My friend is currently employed with Company A but had his PERM processed through Company B. The PERM was approved on first week of June, 2025. However, Company B is reluctant to file the I-140 petition, citing the requirement to submit audited financial statements for the past three years.
- Is it mandatory for an employer to provide audited financial statements for the last three years when filing an I-140?
- Are there any alternative options to file the I-140 without submitting the audit reports?
- My friend has completed two years on H1B. Based on the approved PERM, is it possible for his spouse to apply for H4-EAD?
