Hi everyone,

My employer submit an I-140 application in EB3 category and due to retrogression I have to wait 4 more years. Instead of waiting I want to apply for the F2 because my husband is doing his PhD and he is in F1. In DS-160 should I have to mention that some have file petition on behalf? if yes what is the best description for this. Even embassy know that before approval or not? anyone help would be appreciated!

Answer yes if I-140 or I-130 was ever filed by you or your employer in the US. I-140 is usually filed by employer for H1B employers. I-130 is family green card.

What is the best answer if question raise during visa interview and how should I describe in the description section only confirmation number is enough or I have to explain more?
