Hi experts. I am writing to get your opinion. My wife and I got our EB3 EAD / AP recently through the downgrade. I am the primary petitioner. She is currently on her own H1b.
She is looking to switch employers and the new employer doesn’t want to transfer her existing H1b.
So our questions are:
- If she moves to EB3 EAD, can I still continue on my H1b status? Or does it forces me to EB3 EAD also?
- Is it advisable to move to EB3 EAD since the dates have meaningfully retrogressed?
- Does she have the option to go back to her H1b in future?
