Hi I am an Indian Citizen working in US with a valid L1A visa. My younger daughter is a Canadian citizen so while entering the US in Sep 2024, she was given a B2 visa and her I94 was valid till March 2025, which is expired now. While working for renewal for my L1 Visa (valid till March 2026) I noticed about this issue. I contacted couple of lawyers they are saying to email to CBP and ask for correction in the I94 from B2 to L2 as she is my dependent or other option is to cross border or file I539. Can you please share any experience in such case how should I handle this.
Your child should have been given L2 visa.
You can reach out to local CBP office (located at all international airport) and request them to fix the visa type.
Thank you so much. I have a few follow up questions:
-
Should I reach out to local CBP through email even though the B2 has expired?
-
My I94 is stamped for shorter period till March 2026 (due to passport expiry) even though L1 is approved till May 2027. Should I go through land border (Niagara) and get both the things updated at one go. Do you see any risk to this?
-
After sending email, should I wait until their response or in parallel should I go ahead with the Point 2 above?
-
Is there a difference between land border and airport border office ? attorney told me that land border they may or may not update I94, so prefer airport entrance. Further they said to check the online portals for people’s experience. I want to know your thoughts and experience on this.
Thank you in advance.
Please if you can help on this @anil_am22
It is your choice based on your comfort level to contact CBP office or exit and enter through border.
If I was in your place, I would try CBP office first.
I did write to CBP and they responded back positively within 48 hours and corrected I94.Thank you @anil_am22 for your valuable guidance.
