I94 Revalidation for H4 EAD Auto Extension

Hello Everyone,

Looking for some advise/Opinions on below queries related to I94 Revalidation:

Current Scenario -

  1. Currently working on H4 EAD and My H4 Visa (i797 and stamped both) and EAD both are expiring on Jan’2025
  2. Applied for extension in Oct’2024 and currently in Pending status.
  3. Received approval H1B i797 notice for my Spouse.

Queries:
Based on the current waiting time, i am not expecting my approval by Jan’2025 and I am thinking to go to Mexico for I94 Revalidation to extend my I94 based on approved spouse H1B (I797 approval notice).

  1. Am i eligible for I94 automatic re-validation, since I have valid stamped Visa until Jan’2025? and one of the eligibility criteria for revalidation is to have expired stamped Visa.
  2. If I travel outside US (To Mexico), will it impact my pending H4 and EAD applications? Do I need to reapply both the applications?

You can visit Mexico border and request a new H4 i94 based on the extended H1B i94.

Thank you!! Anil for sharing the detailed post. I gone thru your article and most of my queries are clear. However I am still confused about my pending H4 application. Once I get my I94 extended thru I94 automatic revalidation process. Do I need to reapply for H4 or follow the same EAD interfile process for H4 application as well.

Pending H4 will become useless once you get extended H4 i94.

At that time, you can either withdraw pending H4 or leave it as it is.

Hello, I am in the same situation, Can you please tell me is it better to go to border closer to the EAD end date or any time before. Thanks!

Closer to the i94 expiry date is better option.
