I94 validity after H1 transfer

Hi Anil,
My current H1B I94 with employer A is valid until Feb 2026 and I got a new offer from company B and filed my transfer. I have my I140 approved as well. Assume my transfer to company B is approved and I got 3 years validity say up to end of October 2027. Below are my questions:
b) Can I stay with my old employer A even though my transfer to company B is approved…?
c) Company A I94 is valid only upto Feb 2026 and company B I94 is valid up to October 2027…since I am not joining Company B, will it cause any problem if I apply for visa extension from Company A next year…? Also do I need to submit the I797A notice from Company B during Company A Visa extension…?

Thanks & Regards,
Krishnan.

You can choose to stay and keep working for Company A.

They can file the H1B extension before Company A’s H1B i94 expires.

No, you will not need the Company B docs for Company A’s H1B extension if you never worked for Company B.

Hi Anil,
Thanks. Further to your answer on Question c), does the same apply for H4 extension as well…? i.e I no need to submit H4 approval which I got from Company B and use H4 approval got from Company A when I am filing H1B extension via Company A…?

H4 does not have any direct relationships with H1B employer.

So, H4 approval that you have using company B’s H1B with longer H4 i94 will stay valid until it expires.

As long as you maintain the H1B (with any employer), this H4 can be used till its valid.
