Is H1B i797 enough to get H4 visa stamping?

Hello,

I am in the middle of H-1B job transfer and employer is planning to do the process in premium mode. My wife has H4 and it is valid until 10/01/202. Currently she is not working and she is planning to go to India in August or September ,stay at least 5 or 6 months. And her visa stamp in the passport has expired already.

  1. Does she need any approval from USCIS for visa stamping in India ?

  2. Does my I 797 approval with new employer would be sufficient for her for visa stamping ?
    Both of us planning to go to visa stamp together in Jan/Feb 2020.

  3. Her EAD has expiry date as 10/01/2021. If we get new I797 approval can we do EAD extension later ?

H4 does not need any kind of separate Approval from USCIS for H4 visa stamping.

Your approved H1B i797 is enough.

You can apply for H4 EAD extention as per your wish and choice of timing.
