My wife and I entered US on L1B / L2 in 2019 and changed our status to H1B and H4/ H4EAD from within US in 2024. My wife needs to travel to India for a personal situation and needs to get her H4 visa stamped before heading back due to COS.
I am hearing a lot of folks saying that their spouses visa was denied with 221g because H1 Visa was not available. Will that be applicable to my wife as well since i am in US and I haven’t had my H1B stamp yet? I have been looking at some documents in this forum that valid i797 with i94 and proof of employment in US will suffice for H4 visa, but wanted to re-confirm
