I was given WARN notice from Amazon in Jan with April as termination date. I have another employer a start up ready to file my petition next week for H1B, LCA was done with multi slot.
I am not working for Amazon, not doing any work and my access has been cut off. Can I join company B and collect severance and paycheck during warn notice from Amazon. Do I need to tell new employer about this as well? I might have an overlap of 4 weeks.
I read few posts of people who were in similar situation, and also spoke to one lawyer and they recommended since I am not actively working for employer A and the pay + severance is an obligation per WARN notice I should be able to look for other job outside which is also started in the document. I can start working actively once the petition is approved with employer B. If there is USCIS RFE which they usually ignore during 1-2 weeks overlap as part of transition and if you can prove that this was part of termination contract it should be fine and I am not breaking any immigration law.
