Overlapping H1B and timeline

I was given WARN notice from Amazon in Jan with April as termination date. I have another employer a start up ready to file my petition next week for H1B, LCA was done with multi slot.

I am not working for Amazon, not doing any work and my access has been cut off. Can I join company B and collect severance and paycheck during warn notice from Amazon. Do I need to tell new employer about this as well? I might have an overlap of 4 weeks.

It is better to tell Amazon as they need to withdraw your H1B.

I heard from a lawyer that a concurrent H1B can be filed.

“Can be” filed and “will be” filed are two different things.

If they can file the concurrent H1B, then, good for you.
