Regarding H1B Extension and H4/EAD Applications

I am currently on an H1B visa XXXX University, valid until July 2025. However, my employer will confirm the extension of my H1B status after three months. Since I have an I-140 approval under the National Interest Waiver (NIW), which does not require employer sponsorship, I would like to explore the option of applying for my H1B extension independently, without waiting for the employer’s confirmation.

My husband is also in H1 and i140 is approved but he just got layoff by his employer.

In addition to my extension, I would also like to include my dependent spouse from h1 to h4 and children in the application for their H4 status. Additionally, I would like to apply for an Employment Authorization Document (EAD) for my spouse.

Could you please advise on the process for moving forward with this, including any potential challenges or considerations I should be aware of?

You can use the i140 as the basis of applying H1B extension beyond 6 year limit but you still need a sponsoring employer who can sponsor H1B for you
