Request for Initial Evidence of I-130 Petitioner Citizenship document

Hi,

I filed I-130 & I-485 (Together) in September in F2A Category (my wife is Green Card Holder).

Currently, I am on H1B.

Priority Date: 17 September 2019
Fingerprint Appointment: 18 October 2019 (Notice date: 27 September 2019)
Fingerprint Review is completed as of 18 October 2019.

RFE issued on 11/06/2019 (online status update). Received in mail on 11/12/2019.

RFE States that " This office is unable to complete processing of I-485. We need more information from you in order to make a decision. You must submit evidence to establish that the petitioner on Form I-130 is a United States Citizen."

  1. Copy of birth certificate shows birth in the US.
  2. Naturalization Certificate of Citizenship.

Anyone, please suggest what should be the further step?

Thanks in advance

Hi @Darshak_Dhanani

Did you fill the I130 form correctly to show that your wife is a ‘green card’ holder and not a citizen?

Can you verify the I130 form?

Hi Anil,

Thank you for response.
Yes, on my I-130 it shows as Lawful Permanent Resident.
And I also sent them greencard copy with forms.

Hi @Darshak_Dhanani

Then, you can reply to USCIS explaining the same situation that your sponsor is not a US citizen. You can also attach your wife’s green card copies.
