Hi everyone,
I have a question regarding H4 and H4 EAD. My current H1B is expiring on November 7th, but I’ve upgraded it to premium processing and expect approval within a week.
My wife’s H4 and H4 EAD are also set to expire on the same date. What are our options to ensure she doesn’t fall out of status and that her work isn’t interrupted?
Once my H1B is approved, can she travel to Mexico or Canada and re-enter the U.S. using my new I-797 approval notice before Nov 7th? Would that automatically update her I-94 and help extend her H4 status?
If yes, could she then rely on the automatic H4 EAD extension to continue her employment without a gap?
Any advice or similar experiences would be greatly appreciated.
